LETTERKENNY Town Council is to investigate concerns over a development at the town's Crieve area amid claims that up to 30ft. of filling has been illegally deposited by the developer.
Councillor Neil Clarke has called on the local authority to enforce its planning laws and demand the removal of the filling which he said has been deposited by GDC Ltd.
In a motion at this week's council meeting, Councillor Clarke said the filling has been deposited on lands north of Rockhill Road at Crieve. He insisted that all future planning should be refused to GDC Ltd. until the offending material is removed and the planning laws complied with.
"When something like this is done, it's very hard to undo it," he said.
"There are laws here. We have to be seen to uphold the planning laws to the best of our ability," he added.
Councillor Clarke said it was his understanding that planning permission is required if the level of ground is changed by more than three feet.
"There's a change of 30 feet here," he pointed out.
Town Planner Ruth Diver said she had no details on the case but promised to look into the matter further.
At the same meeting the County Manager was informed that an unapproved road into a site in the Carolina Park area of the town had resulted in serious drainage problems for residents there.
He promised to 'get tough' on rogue developments.
