A District Court Judge has refused jurisdiction in hearing the case of Anthony Rodgers of Mullaghduff who pleaded guilty to entering Dungloe Garda Station and launching an unprovoked attack on a member of gardai there.
At a recent sitting of the local district court, Inspector Eugene McGovern outlined to Judge Desmond Zaidan that on October 25, 2006 Rodgers walked into the station at Meenmore, Dungloe and proceeded to attack Garda Patrick McGrath by striking him with his fist. The court also heard that Garda McGrath sustained significant injuries and a medical report was handed into Judge Zaidan.
On hearing a brief outline of the evidence against Rodgers, Judge Zaidan stated that because of the manner of the offence committed he would refuse jurisdiction and adjourned the case for the preparation of a book of evidence. Inspector McGovern said it would be possible to have this prepared by the 10th July.
Rodgers is now to appear before the same court on this date where he will be served with the book of evidence and returned for trial on a guilty plea.
