A 37-year-old Derrygonnelly man has appeared before Fermanagh Magistrate's Court for the purpose of a Preliminary Enquiry.
Dominic Burns, from Main Street in the village, faces the charge of possessing an imitation firearm appearing to be a pistol with intent to believe it would cause unlawful violence against him or another person.
He was released on his own bail to appear before Enniskillen Crown Court on the 1st April.
Jury sworn in assault case
A jury has been sworn in at Dungannon Crown Court to hear the case against Enniskillen man Keith Francis Burns (64), from Silverhill who faces a charge of indecent assault.
On Monday and Tuesday of this week the trial was dealing with legal submissions, from which the jury is excused. It was anticipated the twelve person jury might start hearing evidence in the case today. Judge McReynolds told the jury the case would probably last three to four days.
State benefit accused
A Fivemiletown woman has appeared before Fermanagh Magistrate's Court for the purposes of a Preliminary Enquiry.
Ann Coyle, from Mullaghfad Road faces the charge that between the 24th August 2002 and 26 July 2006, with a view to obtain income support, she dishonestly failed to promptly notify the Social Security Agency of a change of circumstances that would affect her entitlement, namely that she was married and living outside Northern Ireland. She was remanded on her own bail of £500 to appear before Enniskillen Crown Court on the 1 April.
Drove across solid white line
A 26-year-old Ballinamallard man who contravened a road traffic sign has been fined £150 and given three penalty points at Fermanagh Magistrate's Court.
Resident Magistrate Liam McNally heard how at 10.24pm on the 28th November last year, a police vehicle was driving towards Lisnaskea from the direction of Maguiresbridge when four vehicles, including the police vehicle were approaching the brow of a hill. The second vehicle, driven by the defendant, Aaron Brown from Lettermoney Road, overtook the first vehicle in breach of a solid white line.
This was pointed out to the defendant who, the Court was told, did not accept the option of a fixed penalty notice. Defending, Garry Smyth asked the Court to view the case on the basis that a fixed penalty notice had been offered. He submitted that his client completed the manoeuvre and felt it was safe to do so.
'Young 'un' rang driver
A 41-year-old Enniskillen man faces a £260 fine and has had three penalty points endorsed on his licence for a number of motoring offences.
At a recent sitting of Fermanagh Magistrate's Court, the Resident Magistrate, Liam McNally heard how at approximately 7.00pm on 20th August last year, Anthony Patrick McNern, from Drumbeg was driving along the Cornagrade Road when he was detected using a mobile phone.
He told Police: 'The young one rang me and I answered the phone'. He failed to produce insurance and licence documentation. Defending, Garry Smyth said his client's child phoned him and it was his compulsive reaction to answer it.
