Fermanagh Magistrates Court was told last week how an 18-year old Ballinamallard man damaged the driver's door of a moving car at Wellington Road, Enniskillen in October, 2005 for which he was ordered to pay back £423 by way of restitution.
Mark Abraham, from Baragh gardens, admitted the offence which, through his solicitor, was due to the amount of alcohol he had consumed.
Prosecuting counsel said the incident came to light when the owner of the car informed the Police that his car had been damaged by an individual. The driver explained he was stopped at red traffic lights on Wellington Road, and noticed five youths standing intending to cross, although none did.
"The injured party drove off when the lights turned green and the defendant ran from the side of the road and struck the driver's door", she added.
The Court was told that the driver pointed out the attacker to the Police, and the defendant was arrested and brought to the nearby Police Station where he admitted kicking the car. Asked by the RM, Liam McNally was what behind the incident, Bernard Corrigan, defending, said his instructions were that it was down to his client having taken too much alcohol on the night. He asked that he be given credit for his early plea, and told the Court that Abraham had handed him £140 and was prepared to make restitution within a given time.
Addressing the defendant, Mr McNally told him he had committed an episode of, 'shocking and entirely senseless violence' against another person. But, he added that it was important he had admitted his guilt immediately. He ordered the defendant to pay restitution of £423 and bound him to keep the peace in the sum of £500 for a period of two years, to be paid if he reoffended within the next two years.
