A Tempo man who assaulted two police constables who had come to his home to talk to him about an alleged assault has been bound over, to the sum of £500, to keep the peace for two years at Fermanagh Magistrates Court recently.Appearing before the court, charged with assaulting Constable Gary Wilson and Constable May McLoughlin was Ashley McVitty (21) with an address at Drumcor Road, Edenbane.The court heard that on 6th November, at 12.10 am, police attended the home of the defendant following a report from the injured party that her son had assaulted her. The defendant's father told police that the defendant was in his room. When police went up to the room, the lights were off and the only light came from the screen of the computer the defendant was sitting at. Police said the defendant was listening to music on the computer and that, initially, he ignored police, 'acting as if they weren't there at all'.When police finally got the defendant's attention, they explained to him that his mother had made a complaint against him at which he told them, 'I'm going nowhere'. Police noted the defendant had drink taken.When officers told McVitty that he was being arrested, the court heard, he became violent and pushed a female officer against a wall. The officers managed to get one handcuff on him but he continued to violently struggle and pushed the other officer against the wall, overturning a chair in the process.The defendant was resisting that much police had to call for back-up but the two officers finally managed to get the handcuffs on him. At this point he was cautioned for his behaviour.Both officers were later medically checked and were found to have sustained minor injuries. Defending, Nessa Murnaghan said her client had nothing previous. His instructions to her were that the police presence came as a surprise to him, and he over-reacted to their presence in his home.She submittedt McVitty expressed remorse over this incident and she added that, as he worked away from home, that was why he didn't see the earlier court summons. Sentencing, the RM told the defendant that assaulting two police officers were serious offences.He bound the defendant over to keep the peace for £500 on each count.
