A 52-year-old Belleek man faces a combined £400 fine and has been banned from driving until tested after he came before a recent sitting of Fermanagh Magistrates Court charged on a number of motoring offences.
Resident Magistrate Bernadette Kelly heard how on Tuesday, 9th January, this year police observed a male person asleep in a Vauxhall Astra car on the Roscor Bridge in Belleek. The defendant, Anthony McKeating from Blackrock Park had to be wakened up, the Court heard.
The keys were in the ignition of the car. The defendant was asked his name by police who then detected a strong smell of intoxicating liquor of his breath. His eyes were glazed and his speech was slurred and there was a strong smell of intoxicating liquor off his breath as he spoke.
McKeating was arrested for being in charge of a vehicle while unfit and was conveyed to Enniskillen Police Station where a later breath test showed that he had 103 micrograms of alcohol in 100 micrograms of breath, well in excess of the legal limit. He was told that the matter would be reported to the PPS. He was asked for driving documents and he later admitted to not having any.
Defending, Barry Lynam said that his client was an unfortunate man. He was a 52-year-old who had a serious road traffic collision 30 years ago that had left him with an artificial leg, which added to his problems. His client had been an in-patient in the high dependency unit in the Erne Hospital. He was a separated man and his father died the previous week. However, his client accepted the offences before the court.
Imposing sentencing, Ms Kelly ordered a £200 fine for having no insurance. For having no driving licence, she imposed a £50 fine. For driving under the influence of alcohol she imposed a £150 fine and disqualified McKeating until tested.
