A 'restricted' driver who was detected driving at 65 mph, 20 miles per hour above the limit of 45mph to which he was restricted, has had his licence revoked due to the accumulation of penalty points.
The Court was told that Daniel John McDonnell (20) from Galloon Gardens, Newtownbutler was detected by police driving a blue Peugeot 306 car along the Moorlough Road, Newtownbutler in the direction of Lisnaskea at 7.28am on 16th October last year. Police following the defendant's vehicle recorded his average speed at 65.73mph over a distance of 0.17 miles. The defendant was stopped by police and cautioned for the offence to which he replied, "Yes, I was in a hurry. I am late for work." Defending, Bernard Corrigan told the court the defendant already had penalty points on his licence and was still subject to the young drivers' legislation. Mr Corrigan explained that his client worked as a PVC fitter with a Lisnaskea firm but that he was not working at the moment due to illness. He submitted that the defendant was candid with officers and that he was stopped at an early hour of the morning on his way to work. The RM, Austin Kennedy noted there was a fixed penalty already on the licence. For exceeding the speed of his 'R' licence, the defendant was fined £300 and had his licence endorsed with four penalty points which meant his licence was revoked.
