A 41-year-old Enniskillen man faces a £450 fine and a driving disqualification for motoring offences following a recent sitting of Fermanagh Magistrate's Court.
Resident Magistrate Liam McNally heard how on Sunday, 5th November last year, police observed and stopped a Ford Sierra vehicle driving along the Queen Elizabeth Road, Enniskillen.
Police spoke to the driver, who was the defendant, Patrick Joseph Tummon, from Moyletra Gardens, and found him to have a strong smell of intoxicating liquor from his breath, his eyes were glazed, and he was unsteady on his feet. Breath samples later showed that the defendant had 99 milligrams of alcohol in 100 micrograms of breath, that being 64 in excess. It was also discovered that the defendant had no insurance to drive the vehicle.
Defending, Bernard Corrigan told the court that Tummon was a man who came before the court without any previous convictions. He said he did have insurance for another vehicle but that didn't cover him.
He said he was a man who was going through a particularly difficult time in his life and who had succumbed to alcohol to gain some solace. He submitted that he was employed as a labourer and that his client would be willing to complete the drink drivers' course.
Mr McNally said he would take Tummon's clear record and early plea into account.
For drink driving, he imposed a £250 fine and a 12-month driving ban.
For having no insurance, he ordered a £200 fine and a six-month disqualification.
