A 39-year-old Enniskillen motorist faces a £350 fine and a 12 month driving disqualification after he was detected drink driving.
Fermanagh Magistrates Court heard how on the 18th March this year, police observed a scooter type vehicle driving along the A4 Belfast Road, Killyhevlin, in the direction of Enniskillen.
Having observed his driving, police stopped the defendant, Charles Breen from Meadowvale, Tamlaght and found his speech to be slurred and his eyes glazed. A blood sample was taken and the results showed 217 millilitres of alcohol in 100 millilitres of blood, that being 137 millilitres in excess. It was later discovered that he had no MOT certificate to drive the vehicle.
Defending, Dara Montague told the court that her client was a 39-year-old man who was married with two children.
Referring to the incident, she said it was a moment of stupidity which he would live to regret. His licence, she stated, was of significant importance because of his responsibilities for his children who he drove to school.
She said Breen had been driving for 18 years and fully co-operated with the police at the time.
Mr McNally said it was a very high reading, almost three times over the legal limit. He said he would take note of his record and his early plea. For driving with excess alcohol, he imposed a £300 fine and a 12 month driving ban. For driving with a vehicle test certificate, he imposed a £50 fine.
