A Kesh motorist who left the scene of a road traffic accident was fined a total of £400 on charges of careless driving and failing to report, and was given a conditional discharge for 12 months for failing to stop and keep his vehicle at the scene.
Gavin John Brown (40), from Fortview Park admitted the offences which took place in June last year at Killadeas Road. Counsel for the prosecution, outlining the case, explained there was minor contact between two cars. The first driver stopped, but the second, the defendant, drove on. At the time of the collision, the defendant was overtaking a cyclist. Evidence was given that Brown was followed and made to undergo a breath test, which he passed. Asked by the RM, Liam McNally why he hadn't stopped at the time, Brown said he did stop, but saw no one else had stopped. He carried on and, by the time he got home, there was a Police officer there. Brown was told by the RM that he generally took an extremely serious view of motorists who fail to report an accident. However, in this case, he had passed a preliminary breath test and the damage caused to the other vehicle was minor. He imposed a £200 fine and 6 penalty points for failing to report, £200 for careless driving and a conditional discharge for 12 months for failing to stop and to remain at the scene.
