Breaking glass and damaging a door at Dunnes Stores Fairgreen store in Enniskillen has led to an Enniskillen man being handed a three month suspended prison sentence when he appeared before a recent sitting of Fermanagh Magistrates Court.
Before the court pleading guilty to the charge of criminal damage was Leo Joseph Hoad (28) from Drumbeg in Enniskillen.
The court heard that on 20th July last year it was reported that a window had been broken in the door of Dunnes Stores.
Blood was found at the scene and this led the police to arrest the defendant on suspicion of criminal damage. The court heard the cost of the repair of the door would be £1700.
Solicitor for the defence explained the defendant was a single, unemployed man who received Income Support. The solicitor said this was not a pre-meditated act by the defendant, rather it happened while the defendant was walking past the store. The court heard it was the defendant reacting to an incident earlier in the day which had aggravated him.
Since this incident the defendant sent a letter of apology to Dunnes Stores.
Sentencing, Resident Magistrate Austin Kennedy noted the defendant had three previous convictions for criminal damage and he told the defendant this was a 'serious offence'.
For damaging the door the defendant was sentenced to three months imprisonment, suspended for two years. He was also ordered to pay restitution at a rate of £80 per month.
