After taking a vehicle without the owner's consent an Enniskillen man crashed the car and was arrested for driving with excess alcohol, Fermanagh Magistrates Court has heard.
Appearing before the court charged with a number of motoring offences was twenty year old Dominic McGoldrick from Cavandale.
The court heard that in the early hours of 28th July last year, along Kesh Scenic Route, Lisnarick, police spoke to the defendant who was standing close to an upside down black Vauxhall Corsa.
The defendant had a strong smell of alcohol from him and he told police he had stolen the car that was crashed. He was arrested for driving with excess alcohol and taking a vehicle without the owner's consent.
An evidential specimen of breath revealed he was 40 in excess of the legal drink-drive limit
Bernard Corrigan, defending, said his client accepted at the scene that he had taken the vehicle without the owner's consent.
The defendant was described as a twenty year old unemployed man on benefits and the court heard the vehicle belonged to a friend of the defendant's who was staying at a local caravan park.
Resident Magistrate Liam McNally said he would give the defendant credit for his plea and for taking and driving away he handed down a conditional discharge for 18 months.
For driving with excess alcohol he was fined £150 and disqualified from driving for 12 months while for driving without insurance the defendant was fined £150 and disqualified from driving for six months.
