A 28-year-old Enniskillen motorist faces a £300 fine and a 12 month driving disqualification after he was caught drink driving and came before a recent sitting of Fermanagh Magistrates Court.
Resident Magistrate Liam McNally heard how on 25th May this year the defendant, Jason Roy Glass, from Glebe Park, was detected driving erratically along the Sligo Road, Enniskillen. He subsequently failed a breath test, to which he replied: 'It's not fair, I only had one drink'.
The lower reading of a subsequent test showed Glass had 72 micrograms of alcohol in 100 micrograms of breath, that being 37 in excess.
Defending, Garry Smyth accepted that it was a high reading before adding that his client had no previous relevant convictions.
He said that Glass had been driving since the age of 17. He was now 28 and the loss of his licence would have a major impact on him as he was a self-employed building contractor, who travelled to various sites, many from outside the locality.
As a result, he added, his client would suffer for his misjudgement on the evening in question. He said he would be prepared to undertake the drink driver's course.
Mr McNally said he would take Glass' early plea into account. He imposed a £300 fine and disqualified him for 12 months. The sentence, he said would be reduced by three months upon successful completion of the drink driver's course and on full payment of the fine.
