A Kesh man who was detected driving while disqualified now has a prison sentence hanging over him after he was handed a suspended sentence when he appeared before Fermanagh Magistrates Court recently.
Thomas Patrick Kane (59) from Camplash Road was stopped by police driving a Vauxhall Agila along Brownhill Link in Irvinestown on 23rd September. The defendant admitted that he had previously been disqualified at Ayr Sheriff's court in Scotland from driving. This, in turn, invalided his insurance.
Defending, Heather Phillips, BL, asked for credit for the early plea in this case. She said her client didn't believe his disqualification carried from Scotland to here, and she pointed out the car was taxed and insured. Ms Phillips suggested there was some confusion over the length of disqualification as he was eight years into his disqualification - which was believed to be ten years.
District Judge Liam McNally sentenced the defendant to four months in prison, suspending this for three years. He also disqualified the defendant from driving for four years. For no insurance, Kane was fined £300 and disqualified from driving for four years.
