Defendant thought he was going to get run over

A young Enniskillen man who was spotted by police behaving in an aggressive manner in the Diamond area of Enniskillen in the early hours of 12th August last year has appeared before Fermanagh Magistrates Court charged with disorderly behaviour.

Before the court was 18-year-old James Kettyles from Brackvede Park.

The court heard, around 2.30am on the night in question, police observed the defendant running alongside a vehicle punching towards the vehicle and acting in an aggressive manner towards the car driver.

The defendant was stopped and spoken to about his behaviour. He was interviewed about the incident on 26th September.

Defending, Sean McHugh said the defendant had been out the previous evening and had too much to drink. When the defendant was crossing the road a vehicle was coming towards him and the defendant believes this vehicle accelerated towards him. Kettyles took issue with this and complained to the driver in the manner described.

The defence solicitor said the defendant accepts the prosecution's version of events and said the defendant and the driver of the car have since been reconciled.

Resident Magistrate Liam McNally said he was going to deal with the matter in two ways. Firstly he fined him £100 and, second, he bound him over to keep the peace to the sum of £300 for a period of 18 months.
