Being disorderly in a public place, namely Dolan's Centra store in the Diamond area of Enniskillen, has led to a court appearance before Fermanagh Magistrates Court for Anthony Williamson (28) from Windmill Heights in Enniskillen.
The defendant appeared before the court charged with unlawful assault and disorderly behaviour. On these charges, he was fined a total of £300.
The court heard that on 12th September last year, police received a report that a member of the public shouted abuse at staff at Dolan's Centra store around 10.00am.
The defendant was captured on CCTV footage as being in the store and shouting at staff. When police spoke to the defendant later that morning, he admitting being in the store and admitted shouting.
Defending, Bernard Corrigan described the defendant as a 28-year-old unemployed man in receipt of benefits. Mr Corrigan said that a Constable Haire spoke to the defendant on the day of the incident and the defendant immediately accepted that this incident took place.
According to the defence, the defendant entered the store with someone who was barred from the premises and, when this individual was spoken to, both individuals took exception.
Mr Corrigan said that the assault on Niall Dolan was an assault of a technical nature. Mr Corrigan submitted that there was no actual violence, although he accepted that the injured party was 'certainly in fear' that an assault on his person was going to take place.
He told the court that his client was in 'quite a state at this time of the morning' and he added that he had been drinking for the previous two days.
The defendant has a problem with alcohol and, until this was sorted, Williamson, he stated, ran the risk of coming before the court again. He added that his client had returned to the shop days after this and apologised to the female shopworker involved.
For the unlawful assault charge, Resident Magistrate Mr McFarland fined the defendant £200, while a £100 was imposed for disorderly behaviour.
