Motorist three times over the limit

A 33-year-old Enniskillen woman faces a £250 fine and has been disqualified from driving for 12 months after she was detected drink driving and came before a recent sitting of Fermanagh Magistrate's Court.

Resident Magistrate Liam McNally heard how on the 7th November last year, police were called to the scene of a single vehicle road traffic collision on the Enniskillen Road, at Irvinestown. A strong smell of intoxicating liquor was detected from the driver, Bridget Helena Kearns from Drumbawn Close. She subsequently failed a breath test, was arrested and conveyed to Enniskillen Police Station where a further breath test showed she had 105 micrograms of alcohol in 100 millilitres of breath, that being three times over the legal limit.

Defending, Barry Lynam told the court that his client accepted that the reading was very high. However, he went on to explain that on the day in question his client was driving to see her partner who was in hospital. She knew she shouldn't have been driving and had decided to go home but it was in doing this that the collision occurred and she was detected over the legal alcohol limit.

Mr McNally said this was a very high reading and added that it was fortunate that nothing untoward further happened. However, he said he would consider Kearns good record and early plea. For the offence he imposed a £250 fine and a 12 month driving ban, and deemed the defendant suitable to comply with the drink drivers programme, which on successful completion would reduce her disqualification by three months.
