Drink-driving in brother's car

Driving a vehicle without the owner's consent, driving without insurance and driving with excess alcohol are the charges Enniskillen man Dillin Martin faced when he appeared before Fermanagh Magistrates Court recently.

The court heard that in the early hours of 17th December last year police stopped the defendant, Dillin Martin (23) with an address at Drumcor Hill in Cornagrade driving a Vauxhall Astra along the Coa Road.

Police noticed a smell of intoxicating liquor from the defendant and he failed a preliminary breath test. The defendant was arrested and taken to Enniskillen Police Station where he provided an evidential specimen of breath, the lower reading being 86mg of alcohol in 100ml of breath 51 in excess of the legal limit.

The defendant was cautioned for the offence and it later turned out the defendant had taken the car without the owner's consent. The defendant admitted the offence which, it transpired, was his brother's car.

Defending, Garry Smyth said this was the defendant's first appearance before the court on motoring offences.

Mr Smyth said the defendant had been out for the night but had gone out to his brother's house. He then took this vehicle, which belonged to his brother, back into the town. The defendant only has a provisional licence. Resident Magistrate Liam McNally gave the defendant credit for his early plea and fined him £150 and disqualified him from driving for 12 months. For no insurance he was fined £150 and disqualified from driving for nine months and for taking a vehicle without the owner's consent he was fined £50.
