Motorist talking on mobile while driving


Talking on his mobile phone while driving brought Donal Gallagher (20) from Drumbroughas North, Lisnaskea to attention of police in Enniskillen. And when they stopped and spoke to him they discovered the defendant had neither insurance or a vehicle test certificate which has led to an appearance before Fermanagh Magistrates Court for the Lisnaskea man.

The court evidence that on 18th October last year police detected the defendant talking on his mobile phone while driving along the Cornagrade Road in Enniskillen.

The defendant was offered a fixed penalty and was told to produce his driving documents to police. However, he failed to do this and was prosecuted before the court on a number of motoring related offences.

Defending, Garry Smyth described the defendant as a store man who was previously insured on a payment scheme but payment for this had defaulted and his insurance had therefore lapsed.

Mr Smyth said his client accepts he wasn't insured but said he was anxious to get back on the road legally.

The court heard the defendant was given a fixed penalty option on the mobile phone charge but he lost the paperwork.

Sentencing Resident Magistrate Liam McNally imposed a £60 fine for use of a mobile phone while driving. For driving without insurance he was fined £200 and had his licence endorsed with six penalty points. For failing to produce his licence and driving without a valid test certificate fines of £50 were imposed on each charge.
