Driving erratically leads to drink-drive detection


A motorist who drove erratically along Belmore Street, Enniskillen in front of a police vehicle was pulled over and subsequently found to be driving over the legal alcohol limit.

Charged with driving with excess alcohol was Paul Joseph Neill (40) from The Hollows, Ratoran, Tempo.

The court heard that on 23rd February this year, around 9.00pm, police noticed the defendant's vehicle driving erratically in front of them along Belmore Street in Enniskillen.

Police signalled for the defendant to stop and the defendant stalled his vehicle. When they spoke to him, his eyes were glazed, his speech was slurred and he was unsteady.

The defendant failed a preliminary breath test and was arrested on suspicion of drink-driving. He was taken to Enniskillen Police Station where an evidential specimen of breath revealed a lower reading of 105mg of alcohol in 100ml of breath.

Defending, Garry Smyth described the defendant as a 40-year old married man with three children and he told the court there would be consequences from the inevitable disqualification.

Mr Smyth said his client had been out socialising with family and accepted he should not have got in the car and driven. Mr Smyth asked the defendant he given credit for his early plea and that the disqualification be kept to a minimum.

District Judge Bernadette Kelly noted the defendant has a previous relevant conviction and also said this was a high reading. She fined the defendant £300 and disqualified him from driving for three years.
